Criminal Case

A jury found the defendant guilty of murdering his grandmother. The trial judge sentenced him to death. In a federal habeas corpus proceeding the defendant claimed that the judge’s remarkable bias against one of his lawyers had resulted in an unfair trial.

“That he sat in judgment of his own fitness to try this case—injecting his own testimony at will, verbally manhandling and threatening to jail the attorney who had the temerity to suggest that the judge might be called to the witness stand, and swatting down objections as if they were flies at a picnic—was a travesty. That he went on to preside over Mr. Jones’ trial for capital murder deprived the defendant of due process.”
